8. What are the legal consequences for violating copyright law?

Violations of copyrights can also occur in the academic context. This is often not intentional, but happens as a result of misunderstanding legal regulations.

If your rights have been violated, you have the following claims against the responsible person. Please document (at least via email) that you have made your claims:

  1. Elimination of the violation: E.g. having the content removed from a website or giving credit to the author using a correct citation.
  2. Ending the violation: If there is a risk that the violation will continue to take place.
  3. Compensation for damages: If the violation was intentional or negligent, then you can request compensation for the resulting damages, repayment of the resulting earnings or payment of a fictional licence fee.

Conversely, these claims can be made against you if you violate copyright law. In the worst case scenario, you will get a written warning including a fee to be paid. Important: If you receive such a written warning in your work capacity, please contact Legal Affairs right away and pay the charge until the legal situation has been clarified.
